This privacy notice (“Notice”) is designed to help you understand how Anna Eloranta Oy and Khadduri Legal Consulting (“we,” “us,” “our firm”) collects, uses, and shares your personal information and to help you understand and exercise your privacy rights. For the purposes of the processing and this Notice, Anna Eloranta Oy and Khadduri Legal Consulting act as joint controllers.

This Notice applies to personal data processed by us on our website defendoprivacy.com (“Website”) and related services (“Personal Data”). By visiting our Website or accessing our services, you are agreeing to the terms of this Notice. This Notice is incorporated by reference into the Website Terms of Use or other agreements governing the use of our services.​

We are committed to respecting and protecting the confidentiality, accuracy, and security of your personal data that may be in our possession. We comply with the EU General Data Protection Regulation (“GDPR”) and Canada Personal Information Protection and Electronic Documents Act (“PIPEDA”), and the local governing laws applicable to the personal data we process. Our compliance applies to all partners, employees, contractors, and agents in providing services to our clients. 

Capitalized terms not otherwise defined in this Notice shall l have the meaning ascribed to them in the Website Terms of Use. 

Collecting Personal Data

We, our contractors, and third-party hosts/platforms, may collect and store any information you choose to put in an e-mail, contact form, or comment you send us (or them). Our Website does not collect or store payment information. We, and/or our contractors, may also collect data on how our Website is used, for example number of page visits and duration, type of browser, visitors’ devices’ Internet Protocol (“IP”) addresses (which include general location). Some “usage data” comes through “cookies” (basically small data files sent to your device when visiting our Website) and other tracking technologies (we’ll refer to them collectively as “cookies” for convenience), as described below. Our Website is not meant to collect information that may be considered “sensitive” or special categories, nor any Personal Data from anyone under age 18.

  • To perform conflict of interest searches and determine whether we can or will enter into a professional relationship with you;

  • To send and advise you, our clients, and others of our newsletters and other outreach and events, and to make them aware of our legal services;

  • To send and communicate with you and others to send greetings, gifts, and cards from our firm;

  • For any other reasons for which we have your consent;

  • For other purposes as permitted or required by applicable laws and regulations, including but not limited to complying with legal and regulatory requirements such as Anti-Money Laundering;

  • To gather and review evidence that is relevant to legal issues affecting our clients or us; and

  • Any other reason that may be required and is permitted by law.

Retention of Personal Data

We will not keep your Personal Data for any longer than is necessary to (i) fulfil the purpose for which the Personal Data was collected, (ii) to comply with any legal, regulatory, or reporting obligations or (iii) to assert or defend against legal claims.

Transfer of Personal Information

We may store or process your Personal Data outside your city, province, state, or country, including through one of our contractors (described below). Your Personal Data may be stored in a jurisdiction that operates under privacy and data protection laws different from (and potentially less protective than) those of your home jurisdiction. We will ensure sufficient protections are in place prior to transferring your Personal Data to another jurisdiction.

 

Disclosure of Personal Information

We may disclose Personal Data to third parties when we engage them as data processors in the course of providing you with our services. We will not disclose more information than is reasonably necessary, which is disclosing your Personal Data.

We protect your Personal Data and implement appropriate technical precautions and organizational security measures to protect such information.

We have measures in place to protect your Personal Data, including protecting our files and any information held within those files, accessible only through a password-protected means. All our employees, officers, and company members are trained only to collect and disclose Personal Data when necessary to fulfill your  request and in accordance with this Notice. It is our duty, however, to bring to your awareness of potential risks when providing Personal Data through emails, text messages, and voice messages. Email, text messages and voice messages are not secure mediums, and you should be aware of this when sending us your Personal Data.

We use multiple service providers to operate our business and provide you with our services. Such services include but are not limited to, email providers, website hosting, information management service providers, storage companies, couriers, building security, building management, and cleaners. These providers have limited access to certain Personal Data that is collected and must agree to protect your Personal Data in accordance with privacy policies or agreements including obligations similar to this Notice.

As do most websites, ours uses cookies. Some are necessary for the Website to operate, others we use to help improve and secure our Website, others help us learn about and market to our visitors. If you visit our Website from outside of Canada, we expect our cookie management vendor (below) to block non-essential cookies by default (with your option to grant consent via the cookie banner).

Regardless of your location, you may also manage certain (non-essential) cookies by adjusting your browser settings. Do Not Track (“DNT”) is an optional setting in a web browser that expresses a preference that websites not track your on-line behavior elsewhere. Particularly given the limited amount and type of information and Personal Data collected through our Website, we may or may not have identified all possible uses, or restricted contractors’ or third party hosts/platforms own use or disclosure of information or data. We are not responsible for the conduct or policies of our contractors (or their subcontractors) or of third party hosts/platforms.
